Any mortgage rates, annual percentage rates, payments, closing-cost estimates, home-value estimates, equity estimates, affordability calculations, calculators, scenarios, or similar information displayed through the Service are provided for informational or illustrative purposes unless expressly stated otherwise.

Actual rates, payments, fees, loan amounts, costs, and terms may vary based on factors including:

Tag Lending Group maintains administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, acquisition, disclosure, or destruction.

However, no internet transmission, electronic communication, or information-storage system can be guaranteed to be completely secure.

You should not submit highly sensitive information through an unsecured website field, email, SMS message, or other communication method unless Tag Lending Group has instructed you to use that method for the information involved.

Third-Party Platforms, Applications, and Service Providers

Tag Lending Group uses third-party platforms, applications, technology providers, and service providers to support its websites, mortgage operations, customer relationship management, communications, document management, analytics, financial verification, security, customer retention, and related business activities.

These providers may include, depending on the particular service:

  • HubSpot
  • Box
  • Arive
  • Plaid
  • SalesMessage
  • RingCentral
  • MILO (mymilo.ai)
  • Other authorized technology or service providers

The specific providers we use may change over time.

Some third-party services may have their own terms of use, privacy policies, consent requirements, or other agreements. Your use of those services may therefore be subject to both these Terms and the applicable third party's terms.

MILO Third-Party Application

Tag Lending Group may use MILO (mymilo.ai) as a third-party application and technology service provider. MILO is not owned or operated by Tag Lending Group.

MILO may be used in connection with customer retention, customer engagement, relationship management, mortgage-related opportunities, home-value and equity information, customer communications, data intelligence, and related business functions.

Depending on the MILO functionality enabled by Tag Lending Group, information may be transferred to, processed by, obtained through, analyzed by, or integrated with MILO through authorized methods such as APIs, database connections, file transfers, CRM integrations, or other technology integrations.

Certain MILO functionality may involve:

  • Property information
  • Home-value or equity information
  • Customer engagement information
  • Home-search or property-related activity
  • Mortgage-related opportunity or intent signals
  • Customer relationship information
  • Behavioral or engagement indicators
  • Automated technologies or artificial intelligence
  • Integration of applicable information with Tag Lending Group's CRM or other authorized systems

Information, estimates, signals, alerts, or other insights generated through MILO are provided to assist with customer engagement and related business activities and should not be interpreted by themselves as a mortgage approval, credit decision, property appraisal, commitment to lend, or guarantee of mortgage eligibility.

Tag Lending Group does not rely solely on MILO to make final decisions concerning eligibility for mortgage credit.

Your information may be processed in connection with MILO as described in our Privacy Policy and subject to applicable law.

Plaid and Financial Account Connectivity

Tag Lending Group may use Plaid Inc. (“Plaid”) as a third-party financial-data connectivity provider.

If you voluntarily choose to connect a financial account through Plaid, your interaction with Plaid may be governed by Plaid's applicable terms and privacy practices.

Depending on the service used and authorization you provide, Plaid may facilitate access to financial-account, asset, transaction, income, employment, ownership, or other information for mortgage-related verification and processing purposes.

Using Plaid is subject to the authorizations and disclosures presented during the applicable account-connection process.

Financial Product Use and Consumer Disclosures

If you use the Service to request information about or apply for a mortgage product, you acknowledge that:

  • Eligibility is subject to applicable underwriting and program requirements.
  • Information you provide may be verified.
  • Additional documentation may be required.
  • Applicable consumer reports or credit information may be obtained only as permitted by applicable law and authorization requirements.
  • Rates, pricing, payments, and product scenarios may change.
  • Required disclosures will be provided separately where required by law.
  • Website information does not replace transaction-specific mortgage disclosures or agreements.

Nothing in these Terms independently authorizes a hard credit inquiry where separate authorization is required by applicable law or Company procedure.

Any authorization to obtain consumer reports will be obtained or documented through the applicable application, disclosure, authorization, or other legally appropriate process.

Electronic Communications and E-SIGN

By using the Service, you acknowledge that you may interact with Tag Lending Group electronically.

However, acceptance of these general Terms does not, by itself, constitute consent to receive every legally required mortgage or consumer disclosure electronically where separate consent is required under the Electronic Signatures in Global and National Commerce Act (“E-SIGN Act”) or other applicable law.

Where legally required records or disclosures are delivered electronically and E-SIGN consent is required, Tag Lending Group will provide the applicable disclosure and consent process separately.

That process may address:

  • Your right to receive records in paper form
  • Your ability to withdraw electronic-delivery consent
  • Procedures for withdrawing consent
  • Procedures for updating electronic contact information
  • Hardware and software requirements
  • How to request paper copies
  • Any applicable fees
  • The categories of records covered by your consent

Your consent to receive documents electronically does not alter the substantive rights or protections provided by applicable mortgage or consumer-protection laws.

Telephone, Email, and SMS Communications

Providing contact information through the Service allows Tag Lending Group to respond to your inquiry and communicate with you as permitted by applicable law.

Providing a telephone number or email address by itself does not necessarily constitute consent to receive every category of marketing communication.

Where prior express consent or prior express written consent is required for particular calls or text messages, Tag Lending Group will seek the applicable consent through the relevant form, disclosure, checkbox, agreement, or other appropriate mechanism.

Consent to receive marketing calls or text messages is not a condition of obtaining mortgage credit or purchasing goods or services where prohibited by applicable law.

SMS communications are additionally governed by our SMS Terms of Use.

You may revoke applicable SMS consent through reasonable methods as described in the SMS Terms of Use and applicable law.

For marketing emails, recipients may use the unsubscribe mechanism contained in applicable messages or contact us regarding their communication preferences.

Commercial email is also subject to applicable CAN-SPAM requirements, including applicable opt-out obligations. Federal guidance requires commercial email senders to provide an opt-out mechanism and honor qualifying opt-out requests.

Marketing Preferences

You may opt out of applicable marketing communications using the unsubscribe or opt-out method provided in the communication.

Marketing opt-outs generally do not prevent communications that are independently permitted or required, including certain transaction-related, account-related, fraud-prevention, security, legal, or customer-service communications.

Your communication preferences will be processed in accordance with applicable law.

Analytics, Cookies, and Tracking Technologies

Tag Lending Group may use analytics, cookies, pixels, tags, and similar technologies to operate the Service, understand website performance, improve user experience, measure engagement, maintain security, and support permitted marketing activities.

We do not intend to use general website analytics technologies to collect Social Security numbers, complete financial-account credentials, or similar sensitive NPI directly from secure mortgage application systems for advertising purposes.

Where applicable law requires consent or provides an opt-out right concerning certain tracking, targeted advertising, sale, sharing, or similar processing, Tag Lending Group will provide applicable mechanisms as described in our Privacy Policy.

Optional Third-Party Tools

The Service may provide access to or integrations with third-party tools, applications, websites, or services.

Unless expressly stated otherwise, Tag Lending Group does not own or control those third-party services.

Third-party tools may be subject to their own:

User Submissions and Feedback

If you voluntarily submit comments, suggestions, feedback, ideas, or other non-confidential materials regarding the Service (“Feedback”), you grant Tag Lending Group permission to use that Feedback for legitimate business purposes without compensation or attribution, unless otherwise agreed in writing or prohibited by law.

This provision does not give Tag Lending Group unrestricted rights to use personal information, mortgage application information, NPI, consumer reports, confidential documents, or other protected information.

Those categories of information are governed by applicable law, our Privacy Policy, and other applicable agreements.

You agree not to submit content that:

  • Violates applicable law
  • Infringes intellectual-property rights
  • Contains malicious software
  • Is fraudulent or intentionally deceptive
  • Is unlawfully defamatory, threatening, or harmful
  • Violates the privacy or legal rights of another person

Prohibited Uses

You may use the Service only for lawful purposes.

You may not use the Service:

  • In violation of applicable federal, state, local, or international law
  • To commit or facilitate fraud

No Use by Minors

The Service and Tag Lending Group's mortgage products are intended for adults.

You must be at least eighteen (18) years old and have legal capacity to submit a mortgage application or enter into a binding agreement through the Service.

We do not knowingly solicit mortgage applications from children.

Our treatment of information concerning minors is further addressed in our Privacy Policy.

Intellectual Property

Unless otherwise stated, the Service and its original content, design, text, graphics, software, logos, trademarks, trade dress, and other materials are owned by or licensed to Tag Lending Group and are protected by applicable intellectual-property laws.

You may use the Service for lawful personal purposes consistent with these Terms.

You may not reproduce, distribute, modify, publicly display, commercially exploit, reverse engineer, or create derivative works from protected portions of the Service except as permitted by applicable law or with prior authorization.

Nothing in these Terms transfers ownership of Tag Lending Group intellectual property to you.

Copyright and DMCA

Tag Lending Group respects intellectual-property rights.

Fees and Mortgage Transactions

Mortgage-related fees, costs, deposits, and charges are governed by applicable loan disclosures, agreements, federal and state requirements, and the circumstances of the particular transaction.

Website Terms do not supersede or modify a Loan Estimate, Closing Disclosure, rate-lock agreement, mortgage note, security instrument, or other binding transaction document.

Applicable mortgage disclosures are provided separately in accordance with governing requirements. CFPB rules establish specific content and timing requirements for Loan Estimates and Closing Disclosures.

If Tag Lending Group separately offers non-mortgage products, merchandise, subscriptions, or paid services through a website, additional terms or refund policies may apply and will be presented in connection with the applicable offering.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND GENERAL WEBSITE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

Dispute Resolution and Arbitration

  • Prevents an eligible claim from being brought in small claims court

Individual Proceedings

To the extent permitted by applicable law and enforceable under the circumstances, arbitration under these Terms will be conducted on an individual basis rather than as a class, collective, consolidated, or representative proceeding.

Arbitration Fees

Arbitration fees and costs will be allocated in accordance with applicable AAA consumer rules and governing law.

Where applicable rules or law require Tag Lending Group to pay or reimburse particular arbitration costs, Tag Lending Group will do so.

Location

Unless otherwise agreed, arbitration may occur in a location reasonably convenient to the consumer or through remote proceedings as permitted by applicable AAA rules and law.

Jury Trial

Where a dispute is properly subject to binding arbitration, the parties waive the right to have that dispute decided by a jury.

For disputes that are not subject to arbitration, any jury-trial waiver applies only to the extent permitted by applicable law.

Severability

If a portion of this arbitration section is determined to be invalid or unenforceable, the effect of that determination will be governed by applicable law and the remaining provisions will continue to apply to the extent legally permissible.

Governing Law

These Terms are governed by applicable federal law.

To the extent state law applies, the applicable state law will be determined according to governing choice-of-law principles, the nature of the dispute, the user's residence, the location of relevant conduct or property, and other legally relevant factors.

Nothing in these Terms is intended to deprive a consumer of protections that cannot lawfully be waived through a contractual choice-of-law provision.

Termination or Suspension of Website Access

We may suspend, restrict, or terminate access to all or part of the Service where reasonably necessary, including because of:

  • Violation of these Terms
  • Fraudulent or unlawful activity
  • Security threats
  • Abuse of the Service
  • Legal or regulatory requirements
  • Discontinuation of a website feature

Termination of website access does not cancel or alter an existing mortgage transaction, application obligation, legal right, or regulatory requirement except as separately permitted by applicable law.

Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitations, dispute-resolution provisions, and accrued legal rights—will survive to the extent applicable.

Changes to the Service

We may modify, update, suspend, replace, or discontinue website functionality from time to time.

This does not authorize Tag Lending Group to modify binding mortgage agreements, legally required disclosures, or other contractual obligations through a website change.

Changes to These Terms

We may update these Terms periodically to reflect changes in our Service, technology, third-party providers, business practices, or applicable legal requirements.

When material changes are made, we will update the “Last Updated” date and provide any additional notice required by applicable law.

Changes will apply prospectively unless applicable law permits otherwise.

Your continued use of the Service after updated Terms become effective may constitute acceptance of the revised Terms to the extent permitted by applicable law.

Changes to these Terms do not retroactively expand an existing consumer consent or authorization where new or additional consent is required by law.

Waiver and Severability

Failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

If any provision is held invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by applicable law, unless the invalid provision is essential to the overall agreement and applicable law requires otherwise.

Entire Website Agreement

These Terms, together with our Privacy Policy and any additional terms expressly applicable to a particular website feature, constitute the agreement governing general use of the Service.

These Terms do not replace or modify separate mortgage applications, disclosures, authorizations, rate-lock agreements, loan documents, privacy notices, or other transaction-specific agreements except where expressly stated and legally permitted.

Acknowledgment

BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS AND AGREE TO BE BOUND BY THEM TO THE EXTENT PERMITTED BY APPLICABLE LAW.
